Terms of Service

These are standard SaaS terms provided as a starting template. Please have them reviewed by qualified legal counsel before relying on them for your business.

These Terms of Service (“Terms”) govern your access to and use of the GeofenceKit platform, dashboard, APIs, and SDKs (together, the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Your account

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your workspace and for the API keys you issue. Notify us promptly of any unauthorized use.

2. The Service & SDK licence

Subject to these Terms, we grant you a non-exclusive, non-transferable licence to integrate the GeofenceKit SDKs into your applications and to use the API. The compiled SDK does nothing without an active API key that we authorize; the key — not the code — is your licence, and we may revoke a key that is misused, leaked, or in breach of these Terms.

3. Free trial & plans

New workspaces start on a 30-day free trial with usage limits (device and monthly-event caps). After the trial, continued use requires an eligible plan. Limits, features, and pricing may change with reasonable notice.

4. Acceptable use

Obtain all end-user consents required by law for location processing.
Do not use the Service to track individuals unlawfully or without a lawful basis.
Do not attempt to breach, overload, reverse-engineer, or circumvent the Service or its usage caps.
Do not resell or sublicense the Service except as expressly permitted.

5. Your data

You retain ownership of the branches, campaigns, and event data in your workspace. You grant us the rights needed to host and process that data to provide the Service. Analytics data is retained for 90 days and then deleted; you can export your data as CSV at any time. Our handling of personal data is described in the Privacy Policy.

6. Availability

We work to keep the Service reliable but do not guarantee uninterrupted availability. Background location delivery is also subject to each mobile operating system’s permissions and constraints, which are outside our control.

7. Intellectual property

The Service, including the SDKs and platform, is owned by GeofenceKit and its licensors. Except for the licence granted above, no rights are transferred to you.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, GeofenceKit will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amounts you paid for the Service in the 12 months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or misuse. On termination, your licence ends and we may delete workspace data after a reasonable period.

11. Changes

We may update these Terms; material changes will be posted here with an updated date. Continued use after changes means you accept the revised Terms.
